Terms of Service
Effective date: October 6, 2026
These Terms of Service (“Terms”) apply to your use of the Inward Action Coaching website (the “Site”) and to coaching services and programs you purchase through the Site. By using the Site or purchasing a program or product, you agree to these Terms. If you do not agree, please do not use the Site or purchase our programs or products.
1. Using the Site
You are responsible for having the internet connection and equipment needed to access the Site. We may change, suspend, or discontinue any part of the Site at any time. We do not guarantee that the Site will always be available, uninterrupted, or error-free.
2. Website Content and Intellectual Property
The content on the Site—including text, graphics, audio, video, downloads, logos, trademarks, and other materials—is owned by Inward Action Coaching or its licensors and is protected by applicable intellectual-property laws.
You may use Site content for your personal, non-commercial use. You may not copy, reproduce, republish, sell, distribute, modify, frame, or commercially exploit Site content without our prior written permission.
3. Third-Party Websites and Services
The Site may contain links to third-party websites or services. These are provided for convenience. We do not control or endorse those third parties and are not responsible for their content, products, services, or privacy practices. Your use of a third-party site is subject to that site’s own terms and policies.
4. Coaching and Educational Information
Information provided through the Site, emails, and coaching services and programs is for educational and informational purposes. Coaching does not guarantee any particular result, income, professional outcome, or other benefit. You are responsible for how you use the information and for your own decisions and actions.
Inward Action Coaching does not provide legal, financial, tax, or investment advice. When you need professional advice, consult an appropriately qualified professional.
5. Payments and Purchases
When you purchase coaching services and programs, you agree to provide accurate payment information and to pay the stated price according to the payment terms presented at purchase. If you authorize payment by credit card, you authorize the applicable payment provider to charge the card for the amount you agree to pay.
Payment processing may be handled by a third-party payment provider. That provider may collect and process payment and contact information under its own privacy policy and terms.
If you do not pay an amount when due, or if you voluntarily leave a program, you remain responsible for amounts that you have agreed to pay, subject to any cancellation or refund rights that apply.
6. Refunds
Unless a separate written agreement or applicable law says otherwise, payments for coaching services and programs are non-refundable.
7. Ending Access
We may suspend or end your access to the Site or coaching services and programs if you violate these Terms or for other legitimate business reasons. If access ends, provisions concerning intellectual property, payment obligations, disclaimers, liability, and dispute resolution will continue to apply.
8. Warranty Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE NEW MEXICO LAW, ALL COACHING SERVICES, PROGRAMS, TRAINING, AND MATERIALS PROVIDED BY INWARD ACTION COACHING ON OR THROUGH THIS WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
INWARD ACTION COACHING EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ANY WARRANTIES ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE. INWARD ACTION COACHING MAKES NO WARRANTY, GUARANTEE, OR REPRESENTATION REGARDING THE SPECIFIC BUSINESS, FINANCIAL, CAREER, OR PERSONAL OUTCOMES RESULTING FROM THE USE OF OUR COACHING SERVICES AND PROGRAMS.
9. Limitation of Liability and Remedies
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE NEW MEXICO LAW, IN NO EVENT SHALL THE BUSINESS, ITS OWNERS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, OR LOSS OF BUSINESS INFORMATION, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THIS WEBSITE, THE SERVICES, OR COACHING PROGRAMS OFFERED.
THE MAXIMUM AGGREGATE LIABILITY OF THE BUSINESS FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE WEBSITE, OR THE SERVICES SHALL BE STRICTLY LIMITED TO THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO INWARD ACTION COACHING DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Governing Law, Dispute Resolution, Statute of Limitations
These Terms of Service and your use of this website are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law principles.
We encourage you to contact us first so we can try to resolve any concern informally. If a dispute cannot be resolved informally, the dispute shall be resolved exclusively in the state or federal courts located in Albuquerque, Bernalillo County, New Mexico. The parties will use mediation as described in the applicable written agreement between the parties.
For clients who enter into a separate written agreement with Inward Action Coaching for coaching services or programs, that written agreement shall take precedence. In the event of any conflict between these Terms of Service and your individual written agreement, the terms of your written agreement will control.
In the event that any action, suit, or legal proceeding is instituted to enforce or interpret any provision of these Terms of Service or your written agreement, the prevailing party shall be entitled to recover from the non-prevailing party all reasonable attorneys' fees, expert witness fees, court costs, mediation fees, court-ordered alternative dispute resolution expenses, and all other costs incurred in connection with such proceeding, including any fees and costs incurred on appeal or in enforcing any judgment.
You and Inward Action Coaching agree that any cause of action, claim, or suit arising out of or relating to these Terms of Service, the website, or the coaching programs and services must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred and waived.
11. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on the Site and change the effective date. Your continued use of the Site after an update means you accept the updated Terms to the extent permitted by law.
12. Severability and Entire Agreement
If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply. These Terms, together with any written agreement that applies to a specific purchase or service, are the agreement governing your use of the Site and those services.
